Judicial Review
A process by which the Courts can consider the decisions and actions of public bodies. In judicial review proceedings, the Courts can ensure that local authorities have followed correct and proper procedures when coming to their decisions. These procedures can sometimes include undertaking proper consultation and considering all relevant factors. If this has not happened as a result of judicial review a local authority can be ordered to undertake a complete re-consideration which can in some circumstances result in a change in the way they work and the decision that has been taken.
